PDQ PATENT CLAIMS REJECTED UPON REEXAMINATION

 

            GRIMES, IA, March 10, 2006 – The United States Patent and Trademark Office (USPTO) has issued its First Office Action on the inter partes reexamination of the U.S. Patent No. 6,425,407 (‘407) licensed to PDQ Manufacturing Inc.  Upon reexamination, the USPTO rejected all 36 claims of the ‘407 patent finding them unpatentable in view of prior art.

            PDQ sued Ryko Manufacturing Co. for infringement of the ‘407 patent in September, 2002 claiming that Ryko’s Ultrasonic 2001 OHD Touch Free Wash System infringed on the ‘407 patent.  Ryko contested PDQ’s claims both in the lawsuit and later in the reexamination process.  PDQ had requested reexamination in August, 2004 and the lawsuit was stayed pending reexamination.

            “Ryko has been arguing all along that PDQ had not developed anything new or novel with respect to its ‘407 patent claims”  said Jim Nelson, Ryko’s Chairman of the Board, “We believed the prior art would show this and the USPTO apparently agreed in this regard.  This is a significant validation for Ryko’s position with respect to the ‘407 patent.
